Brief description of the document	The Framework Law on Higher Education in Bosnia And Herzegovina (BiH) has been in force since August, 2007. The law created legal and institutional preconditions for BiH’s integration into the European Higher Education Area (EHEA). Adoption of the law contributed to the integration into the Bologna Process by introducing principles and institutions for complete Bologna Process implementation (i.e. quality assurance, recognition of documents, mobility, introduction of three cycle higher education system, unique module for diploma and diploma supplement, ECTS credit system). In accordance with the law, two state-level agencies were established and are operational. These are: - The Agency for Development of Higher Education and Quality Assurance which, among other competences, is in charge of determining clear, transparent and accessible criteria for the accreditation of higher education institutions and the passing of norms which determine the minimum standards in the area of higher education; - The Agency for Information and Recognition of Documents (ENIC/NARIC) which, according to the Lisbon Convention, provides recommendations on the recognition of diplomas acquired outside BiH for the purpose of employment, continued education and the pursuit of other rights arising from the qualification acquired. The law presents a framework for the education of future research staff in the country and for the recognition of academic titles of scientists who studied abroad and are seeking employment as scientists in the country.
Type of policy proposed	Besides the above mentioned policy measures, the law sets the minimum requirements for the election of academic staff into scientific lecturing functions at higher education institutions, and regulates the acquisition of academic titles which may be lecturing, scientific - lecturing, or artistic ones. The Framework Law on Higher Education in BiH defines the responsibilities of the Ministry of Civil Affairs of BiH, the body which is responsible for enforcement of this law. This body is also responsible for: - the coordination and development of higher education in Bosnia and Herzegovina; - the promotion of integration of the lecturing and research work; - the stimulation of research programs at universities; - the promotion of student and staff mobility in the area of higher education in Europe and worldwide; - the promotion of equal opportunities of access to higher education, expert development and training; - life-long learning and all other higher education aspects; - support to and encouragement of stronger networking among the sectors of higher education, industry, businesses and society.
Procedure for evaluation of the Strategic document	Upon the request of the Council of Ministers of Bosnia and Herzegovina, in 2010 the Ministry of Civil Affairs prepared information on the implementation of the Framework Law on Higher Education in BiH. Since the adoption of the framework law, the Ministry of Civil Affairs has prepared several pieces of information for the Council of Ministers on the execution of the law, including: - information on the beginning of the implementation of the Framework Law on Higher Education in BiH (May, 2008); - information on the execution of legislation in the area of education, adopted at the state level (January, 2009); - information on the activities of the Ministry of Civil Affairs on the development and adoption of the regulations on the use of academic titles, and the acquisition of scientific and professional positions in higher education institutions in BiH (May, 2009); - information on the execution of the Framework Law on Higher education in Bosnia and Herzegovina (December, 2009). These documents assess the implementation of the law.

Description of the evaluation methods	The information is based on the monitoring of the implementation of the law at the level of the entity, Republika Srpska, and at the level of ten cantons in the Federation of Bosnia and Herzegovina. Each level is supposed to adopt legislation regulating higher education on the territory which is under their responsibility in this field.

Reasons for carrying out the evaluation
Main recommendations	The Council of Ministers of BiH made an appeal to the ministries responsible for education, at the level of the cantons, to accelerate the process of adoption of legislation which is in accordance with the framework law.
Input indicators	In BiH, education policy in under the responsibility of the Republika Srpska and the ten cantons in the Federation of Bosnia and Herzegovina. Each level of governance has parliaments, governments and ministries responsible for education.
Output indicators	Output indicators include the adoption of legislation at the level of the Republika Srpska, and at the level of ten cantons, in the Federation of Bosnia and Herzegovina
Impact indicators	Meeting the deadline for completion and organisation of the structure for studies under the provisions of the framework law, as envisaged in Article 58.

Comments on the quality of the evaluation	The information is a formal document which defines the state of the art regarding the implementation of the law. However, the Council of Ministers does not have any legal power, over the cantonal and entity ministries responsible for education, that will impose obligations regarding the implementation of the framework law.
